1) Introduction

Please read these Terms of Use and the other agreements described below before registering for, accessing, or using any portion of the NATIONAL INSTITUTE OF ADVANCED TECHNICAL & MANAGEMENT STUDIES website (the “Site”), which consists of all content and pages located within and accessible at the niatm-edu.com web domain, or any other websites, applications, programs, online portals, mobile products, or services of NATIONAL INSTITUTE OF ADVANCED TECHNICAL & MANAGEMENT STUDIES (collectively, the “Services”).

The term “Services” includes the Site and all content and pages located within and accessible via the Site, as well as any program material, program pages, student pages, directories, portals, and other electronic services available through the Site or any other institutional service.

These Terms of Use, together with our Privacy Policy and Cookie Policy, form the agreements between you and NATIONAL INSTITUTE OF ADVANCED TECHNICAL & MANAGEMENT STUDIES (NIATM). By registering for, accessing, or using any Services, you accept and agree to be legally bound by these agreements, whether or not you are a registered user or have an account. If you do not understand or do not wish to be bound by these terms, do not register for, access, or use any Services.

NIATM may make changes to these agreements at any time. Notice of such changes may be given through the Services or by any other appropriate means. By registering for, accessing, or using any Services after such changes have been made, you signify your agreement to the modified terms and all changes, which will take effect immediately unless a later effective date is stated. If the changes are not acceptable to you, you should discontinue use of the Services.

As used in these Terms of Use, “we,” “us,” and “our” refer to NATIONAL INSTITUTE OF ADVANCED TECHNICAL & MANAGEMENT STUDIES (NIATM).

2) Programs

Through the Services, NIATM may offer online courses, programs, certifications, workshops, learning modules, or other academic or professional offerings in specific areas of study or on particular topics (each, a “Program”).

NIATM reserves the right to cancel, interrupt, postpone, reschedule, or modify any Program or its content, including the point value, structure, grading weight, or evaluation method of any assignment, assessment, examination, or other measure of learner progress that may be provided in connection with a Program.

Programs are subject to these Terms of Use, including the Warranty Disclaimer and Limitation of Liability sections below.

NIATM may offer a certificate, credential, acknowledgment, completion status, or other academic recognition for participants who have satisfactorily demonstrated mastery of Program material. The decision to award any such certificate, credential, acknowledgment, or record of performance shall remain solely within the discretion of NIATM.

NIATM may choose not to offer any certificate, credential, or acknowledgment for certain Programs. In addition, NIATM may decide in its sole discretion whether to provide a record concerning a participant’s performance in any Program. The format, nature, and content of any credential, certificate, acknowledgment, transcript, or performance record may vary from Program to Program and shall be determined solely by NIATM.

If you are enrolled in a Program through another institution, employer, academic partner, or training provider, NIATM may share your record or performance details with such institution or body in accordance with the applicable privacy and data protection provisions. However, the decision whether any third party awards any credit, benefit, transfer, equivalency, or recognition based on a Program will remain solely with that third party.

3) Conduct

You agree that you are responsible for your own use of the Services and for your User Content, as well as any content of others that you submit, post, contribute, publish, upload, distribute, or otherwise make available on any of the Services.

“User Content” includes all content, in any format, submitted, posted, contributed, published, or distributed on any of the Services by a user, including but not limited to notes, questions, answers, comments, text, photographs, images, videos, audio, messages, assignments, files, and uploads. In some Programs, users may contribute through live sessions, voice, video, or webcam, and User Content may include recordings or transmissions of a user’s voice and/or image.

You agree that you will use the Services in compliance with these Terms of Use and all applicable local, state, national, and international laws, rules, and regulations, including privacy laws, copyright laws, intellectual property laws, and laws relating to the transmission of technical or personal data.

Prohibited Content

The following kinds of content are strictly prohibited on the Services:

  • Content that defames, harasses, discriminates against, harms, abuses, or threatens others.
  • Content that discusses illegal activities with the intent to commit them.
  • Content that infringes, violates, or misappropriates intellectual property rights.
  • Content that you do not have the right to disclose.
  • Profane, pornographic, obscene, indecent, offensive, or unlawful content.
  • Advertising, spam, solicitation, or any form of unauthorized commercial promotion.
  • Content related to partisan political activities where not expressly permitted.
  • Content that contains intentionally inaccurate information or is posted with the intent to mislead others.

NIATM reserves the right to remove Prohibited Content of which it becomes aware, but is under no obligation to do so.

In addition, you agree not to:

  • Use any of the Services in any manner intended to damage, disable, overburden, or impair any part of the Services or the systems connected to them.
  • Disrupt or interfere with any Program or any other user’s use and enjoyment of the Services.
  • Attempt to gain unauthorized access to any of the Services, user accounts, systems, databases, or networks connected to the Services through hacking, password mining, or any other means.
  • Obtain or attempt to obtain any materials or information not intentionally made available through the Services.
  • Copy or use any portion of the Services other than as expressly allowed under these Terms.
  • Use any high-volume, automated, robotic, scripted, or electronic means to access the Services.
  • Frame any of the Services, place pop-up windows over pages, or otherwise affect the display of the Services.
  • Manipulate headers, identities, or identifiers in order to disguise the origin of communications transmitted through the Services.

If you participate in any Program, you agree to complete all work, including assignments, projects, examinations, practical work, discussions, and assessments, using only your own original work unless otherwise expressly permitted. You agree not to engage in any activity that dishonestly improves your results, or improves or harms the results of others.

Unless otherwise stated in the respective Program, you agree that any examination, quiz, question paper, assignment prompt, or test material provided in connection with a Program is for your individual use only. Copying, capturing, transmitting, circulating, or providing all or any part of such material to any other person is strictly prohibited and may lead to disciplinary and legal action.

4) User Accounts and User Registration

In order to participate in most Services, you may be required to register for a personal account on the relevant Service (“User Account”) by providing an email address, password, and any additional information requested by NIATM.

For some virtual classroom programs, webinars, interviews, or live sessions, NIATM may provide separate credentials necessary to register for and access the program (“Login Credential”).

You agree that you will never divulge, share, transfer, or allow any third party to use your User Account or Login Credential for any reason. You also agree that you will create, use, and/or access only one User Account or Login Credential unless NIATM expressly permits otherwise, and that you will not access the Services using any credentials other than your own.

You agree to notify NIATM immediately upon becoming aware of or suspecting any unauthorized use of your User Account or Login Credential. NIATM shall not be responsible for any loss or damage arising from unauthorized access to your account or credentials.

In registering for a User Account, obtaining a Login Credential, completing an application, or registering for a Program, you may be required to provide additional information, including your full name, contact details, address, location, identification information, educational records, and other information needed for admission, administration, security, or identity verification.

You warrant that all such information provided by you is accurate, current, complete, and lawful. You also agree to maintain and update such information to keep it accurate and current. If any information provided by you is found to be untrue, inaccurate, outdated, or incomplete, NIATM reserves the right to suspend or terminate your access to any or all Services.

If required as part of registration or admission, you may be asked to submit a photograph, identity document, live image, or other verification evidence. You may also be subject to identity verification during the Program. Such authentication may be performed by NIATM or by an authorized third-party service provider.

By registering for a Program, a student confirms that he or she has sufficient language ability, technical ability, and IT skills to pursue the course and complete the assessment requirements successfully.

5) License Grant to You; NIATM Intellectual Property Rights

In consideration for your agreement to these Terms of Use, NIATM grants you a personal, non-exclusive, non-transferable, revocable license to access and use the Services solely in accordance with these Terms.

NIATM may make content available to you through the Programs or otherwise via the Services (“NIATM Content”). You may access and use NIATM Content only for your own personal, non-commercial use in connection with participating in Programs and using the Services.

You may only copy or modify NIATM Content to the extent necessary for your own personal, non-commercial use, where expressly permitted. You may not transfer, retransmit, distribute, publish, commercially exploit, sublicense, resell, or create derivative works from NIATM Content without prior written permission.

You may not reverse-engineer, decompile, disassemble, or otherwise attempt to access source code for any software used to operate any of the Services.

Certain reference documents, textbooks, articles, third-party materials, or externally licensed resources may be made available with permission of third parties, and use of such materials may be subject to additional rules and conditions. You agree to comply with all such applicable rules and restrictions.

“NIATM Content” means all content or material, in whole or in part, available through the Services, including but not limited to lectures, speeches, discussions, comments, video lessons, audio lessons, quizzes, tests, presentations, assignments, programs, code, layouts, text, images, displays, illustrations, documents, forms, materials, audio clips, video clips, HTML, downloadable files, and software interfaces.

All NIATM Content is the property of NIATM and/or its affiliates, partners, licensors, or content providers and is protected by copyright, trademark, database, and other intellectual property laws.

NIATM logos, trademarks, names, and service marks that may appear in the Services are the property of NIATM. All other third-party names, logos, and trademarks used in the Services remain the property of their respective owners.

NIATM and its licensors reserve all rights not expressly granted in these Terms.

6) User Submissions

The Services may provide you with the ability to upload, submit, transmit, or otherwise make available User Content. With respect to User Content you submit or make available through the Services, and subject to the Privacy Policy, you grant NIATM a worldwide, non-exclusive, royalty-free, transferable, perpetual license to use, reproduce, modify, adapt, distribute, publicly perform, publicly display, store, and otherwise make available such User Content in connection with the Services and institutional functions.

You acknowledge that your User Content may be visible to others and may include personally identifiable information if you choose to provide it.

You represent and warrant that:

  • You have all rights necessary to provide such User Content and to permit NIATM to use it as set out above.
  • You are responsible for any third-party fees or permissions related to the content you submit.
  • Your User Content does not and will not infringe or misappropriate the rights of any third party.

NIATM cannot guarantee that User Content submitted by other users will be accurate, lawful, free from prohibited material, or free from viruses or malicious code. NIATM disclaims responsibility and liability relating to your access to User Content submitted by others.

The Services may also permit you to submit suggestions, comments, or service-related feedback (“Feedback”). By submitting Feedback, you grant NIATM an irrevocable, perpetual, non-exclusive, royalty-free right to use, reproduce, adapt, modify, publish, and otherwise use such Feedback without restriction.

NIATM may review, screen, preserve, remove, or disclose User Content if required by law or if reasonably necessary to enforce these Terms, respond to complaints, protect rights or safety, or comply with institutional or legal obligations.

7) Payment

Unless otherwise expressly agreed in writing by NIATM, full payment for participation in a Program is required at the time of registration, or payment may be accepted through an installment plan as permitted by the institute.

Specific payment requirements and related terms may be displayed on the relevant Program page, registration page, invoice, admission communication, or other official service interface. Payment must be made to NIATM before the applicable deadline.

8) Refunds

If you withdraw 14 (fourteen) days before the start of a Program, you may be eligible, at NIATM’s discretion, for a refund of all or part of the course fee, subject to applicable processing charges.

If you withdraw after the start of the Program or after the fourteen-day period, or if you are found to be in violation of these Terms or any Program-specific policy, you will not normally be entitled to a refund unless NIATM decides otherwise in its sole discretion.

If your participation in a Program is sponsored by your employer, institution, or any third party, the terms of NIATM’s agreement with that third party may govern payment and refunds to the extent different from these Terms.

Price and Payment

  • The price of the Services and any delivery or related charges shall be the price set out on the website or otherwise agreed in writing at the time of order or registration.
  • Prices and charges may include applicable taxes where required by law.
  • You may be required to pay by credit card, debit card, online transfer, gateway payment, installment arrangement, or any other approved payment method, and NIATM may take payment before delivery of the Services.

Withdrawal and Cancellation

  • You may withdraw an order before the contract is formed, if you simply wish to change your mind and without incurring liability, unless otherwise stated.
  • You may cancel the contract within 14 calendar days from the date the contract is entered into, unless the course or service is customized or otherwise exempt under applicable law.
  • If cancellation is valid, NIATM may refund the amount paid in advance after deducting charges for services already rendered before the cooling-off period ends.
  • The right to cancel may not apply to personalized services, rapidly expiring services, or services already substantially performed.

Right to Cancel

  • Subject to these Terms, you may cancel this contract within 14 days without giving any reason.
  • The cancellation period expires 14 days after the date of first registration, enrollment, or access to the course or service, as applicable.
  • To exercise the right to cancel, you must inform NIATM of your decision through a clear written statement by email or other accepted communication channel.
  • To meet the deadline, it is sufficient for you to send the communication concerning cancellation before the period has expired.

Effects of Cancellation

If you validly cancel this contract, NIATM will reimburse payments received from you, excluding the amount attributable to services already consumed by you before or after the cooling-off period, where applicable. After the cooling period, the contract may no longer be cancellable and refunds may not be available.

If NIATM issues a refund, the refund will generally be processed through the same payment method originally used, unless otherwise agreed.

9) Termination of Services

You agree that NIATM, in its sole discretion, may terminate your use of any or all of the Services or your participation in any Program, for any reason or no reason, and that NIATM shall not have any liability to you for such action, except where otherwise expressly required by law or written policy.

If NIATM terminates your participation in a Program other than for cause, NIATM may, in its discretion, consider a pro-rata refund of fees paid in connection with the Program.

Without limiting any other rights or remedies, NIATM may terminate users who repeatedly infringe copyright, violate institutional rules, misuse the Services, or engage in misconduct.

NIATM will not be required to provide any service, certificate, Program access, or related activity if it believes that doing so may violate any applicable law, policy, or institutional requirement.

NIATM also reserves the right to cancel, delay, reschedule, suspend, or alter the format of any Program at any time. If you no longer wish to participate in a Program or use the Services, you may terminate your participation by notifying NIATM.

Upon termination of your right to use the Services, the license granted to you under these Terms will terminate immediately, but other provisions of these Terms shall survive.

10) Links

The Services may include hyperlinks to third-party websites, tools, services, or applications maintained or controlled by others. NIATM is not responsible for and does not routinely screen, approve, review, or endorse the contents, terms, products, or services offered through such third-party sites or applications.

If you decide to access any linked third-party website or application, you do so entirely at your own risk.

11) Eligibility

Registration for an account and participation in any Program or Service is generally restricted to individuals who are legally capable of entering into binding agreements under applicable law.

Certain Programs may require you to be 18 years of age or older. In limited circumstances, users between 13 and 18 years of age may be permitted to access certain Services or Programs with additional requirements, including parental or guardian approval, where applicable.

By registering for or participating in a Program or Service, you represent that you satisfy the age and legal capacity requirements applicable to that Program or Service, and that you meet any other admission, eligibility, technical, or educational requirements stated by NIATM.

If you do not qualify or do not agree to these Terms, you may not use the Services.

12) Choice of Law; Dispute Resolution

You agree that these Terms of Use and any claim or dispute arising out of or relating to these Terms, any Program, any Service, or any content obtained from or through the Services shall be governed by the laws of India, excluding its conflict of law principles.

You agree that all such claims and disputes shall be subject to the competent courts and legal forums having jurisdiction under applicable law. By using the Services, you consent to such jurisdiction and venue, subject to mandatory legal rights available to you under applicable law.

13) Disclaimers of Warranty; Limitations of Liability

To the fullest extent permitted by applicable law, all Programs and Services and any related information, content, or products are provided on an “as is” and “as available” basis without warranty of any kind, whether express, implied, statutory, or otherwise, including without limitation any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement.

NIATM does not warrant that any Service will operate in an uninterrupted, timely, secure, or error-free manner, or that any Service is free from viruses or other harmful components.

Without limiting the foregoing, NIATM does not warrant that:

  • The Programs or Services will meet your requirements or expectations.
  • The Programs or Services will be uninterrupted, secure, or error-free.
  • The Programs, Services, or information obtained through them will be accurate, complete, current, secure, or reliable.
  • Any defects in the Programs or Services will be corrected.

NIATM makes no representation regarding your ability to transmit and receive information through the Services, and you acknowledge that your ability to access the Services may be impaired by technical, network, or device-related limitations.

To the maximum extent permitted by applicable law, NIATM shall not be liable to you or any third party for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, business interruption, service outages, or damages resulting from acts or omissions of other users or third parties, arising out of or relating to the Services, Programs, Terms of Use, or User Content.

To the extent permitted by law, the total cumulative liability of NIATM arising out of or related to the Services, Programs, or these Terms shall not exceed the total amount of fees actually received by NIATM from you in connection with the relevant Program or Service during the preceding twelve-month period, or an equivalent reasonable minimum amount where applicable.

These disclaimers and limitations reflect a fair allocation of risk and form an essential basis of the agreement between you and NIATM.

Certain jurisdictions do not allow limitation of certain warranties or exclusion of certain damages. Where such laws apply, some of the above disclaimers, exclusions, or limitations may not apply to you.

14) Indemnity

You agree to indemnify and hold harmless NIATM, its officers, directors, board members, faculty, employees, representatives, contractors, affiliates, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable legal fees and costs, arising out of or relating to:

  • Your use or attempted use of any Program or Service in violation of these Terms.
  • Your violation of any law or rights of any third party.
  • Any information, material, or content that you submit, post, or otherwise make available through the Services, including any claim of infringement or misappropriation of intellectual property or proprietary rights.

15) Release and Waiver

For certain Programs, you may be required to take one or more examinations, interviews, practicals, or assessments at a designated test site, center, or examination venue operated by NIATM or third parties.

Attendance at and use of such sites may involve risks not present in fully online study. You are responsible for making your own investigation of those risks and assuming them knowingly and willingly.

To the extent permitted by law, your recourse for injury or harm arising from attendance at a third-party test site shall be against the applicable site operator or directly responsible party, and not against NIATM, except to the extent liability cannot lawfully be excluded.

17) Integration

These Terms of Use, together with the NIATM Privacy Policy and Cookie Policy, constitute the entire agreement between you and NIATM with respect to your use of the Services, superseding prior agreements relating to such use.

Additional terms applicable to your registration, enrollment, payment, admission, or participation in specific Programs may be provided to you at the time of registration, on Program-specific pages, or through official communication channels. Such additional terms are incorporated into these Terms by reference where applicable.

18) Waiver

The failure of NIATM to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

If any provision of these Terms is found by a court or competent authority to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be interpreted to give effect to the original intent to the greatest extent permitted by law.

19) Assignment

NIATM may freely transfer or assign any portion of its rights or delegate its obligations under these Terms. You may not transfer or assign your rights or obligations under these Terms without prior written consent from NIATM, and any attempted assignment without such consent shall be void.

Privacy

Your privacy is important to us. NIATM respects your privacy and seeks to comply with applicable data protection laws in relation to personal information processed through the Services.

These Terms and Conditions should be read alongside, and are in addition to, our institutional policies, including our Privacy Policy and Cookie Policy.

For the purposes of these Terms and Conditions:

  1. “Data Protection Laws” means any applicable law relating to the processing of personal data.
  2. “GDPR” means the General Data Protection Regulation where and to the extent applicable.
  3. “Data Controller,” “Personal Data,” and “Processing” shall have their relevant legal meanings under applicable data protection law.

NIATM acts as a data controller for the personal data it processes in providing Services to you, where applicable.

Where you supply personal data to us so that we can provide Services to you, and we process that personal data in the course of providing those Services, NIATM will seek to comply with applicable data protection obligations, including:

The contract and any non-contractual matters arising from it shall be governed by the law of India, subject to applicable jurisdictional provisions and mandatory consumer or data protection rights where relevant.
